DMCA & Copyright

Plain-language summary. If someone copied your work into an app hosted on Fork, send us a notice at dmca@co.fork.me with the six items in section 2. We remove or disable valid claims and tell the user why. If your app was removed and you believe that was a mistake, you can file a counter-notice. We terminate repeat infringers.

1. Designated agent

FORK Apps, Inc. responds to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). Our designated agent:

DMCA Agent, FORK Apps, Inc.
1111b South Governors Avenue, Suite 84934
Dover, DE 19904, United States
dmca@co.fork.me

Email reaches us fastest. Notices sent to other addresses may be delayed while they are routed to the agent.

2. Filing a takedown notice

If you believe your copyrighted work has been copied into an app on Fork in a way that constitutes infringement, send a written notice to dmca@co.fork.me containing all six of the following. A notice missing any of them is not effective under § 512(c)(3) and we may be unable to act on it.

Before you file. Copyright does not cover ideas, names, or the general look of a category of app. If your complaint is about a trademark, impersonation, or private information rather than a copied work, use abuse@co.fork.me instead — it will get to the right people faster.

3. What happens next

We review notices on receipt. Where a notice is valid, we remove or disable access to the identified material expeditiously, notify the user who published it, and forward them a copy of your notice — including the contact details it contains. Do not include information you are unwilling to share with the other party.

Removal is not a judgement about who is right. It is the procedure the DMCA prescribes, and it is reversible through a counter-notice.

4. Counter-notification

If your material was removed and you believe it was removed by mistake or misidentification, you may send a counter-notice to dmca@co.fork.me containing:

We forward valid counter-notices to the original complainant. If they do not notify us within 10 to 14 business days that they have filed a court action seeking to restrain the activity, we may restore the material.

5. Repeat infringers

We terminate the accounts of users who repeatedly infringe copyright, in appropriate circumstances and at our discretion. Deleting and re-uploading the same infringing app, or creating new accounts to do so, counts.

6. False claims

Section 512(f). Knowingly making a material misrepresentation — that material is infringing, or that it was removed by mistake — makes you liable for damages, including costs and attorneys' fees, incurred by the other party and by us. Notices are made under penalty of perjury. File carefully.

7. Other complaints

Copyright is one of several reasons an app may come down. Anyone — registered or not — may report an app or a user for violating our Terms of Service. We review reports on a best-effort basis and may act up to and including removing the app, freezing the account, and notifying authorities.
